2 Mandatory Communication Protocol & Anti-Impersonation Rules

To protect clients against scams, impersonation, low-quality unvetted work, and copyright infringement, Design Quixo operates under a strict, unified communication protocol:

• Exclusive Official Desk: All client orders are coordinated exclusively through our official WhatsApp Business number: +91 86299 27995. Design Quixo does not conduct official client orders through personal social media accounts or unauthorized phone numbers.
• Designers Forbidden From Direct Solicitation: Certified designers operating on our network are strictly legally prohibited under contract from approaching clients directly or soliciting off-platform arrangements.
• Client Responsibility & Disclaimer: If a client communicates with or pays an individual directly without routing through our official desk, Design Quixo disclaims all warranties, quality guarantees, delivery commitments, and financial liability.
• Verification Assistance: Clients may verify any communication at any time by contacting our official administrative team at support@designquixo.com or messaging our verified WhatsApp desk.

3 Nature of Services & 100% Human Craftsmanship Standard

Design Quixo operates an express custom graphic design platform connecting clients with certified human graphic design professionals. We cater to social media post designs, logos, packaging, advertising banners, brochures, flyers, vector art, and corporate branding.

Zero Generative AI Guarantee: We explicitly warrant that our custom graphics are created by human graphic artists using professional industry-standard software (Adobe Illustrator, Adobe Photoshop, CorelDraw, Figma). We do not deliver raw text-to-image artificial intelligence outputs. All deliverables come with organized, layered, editable vector or raster source files upon project completion.

4 Order Placement, Design Briefs & Turnaround Time (TAT)

When placing a design order through our web portal (Order Request) or directly via official WhatsApp, you agree to provide an accurate, clear design brief:

• Brief Completeness: The client is responsible for supplying all required reference files, high-resolution logos, brand style guidelines, text copy, dimensional specifications, and orientation requirements.
• Estimated Turnaround: Design Quixo is renowned for rapid fulfillment, with initial concept drafts for standard tasks dispatched in as fast as 30 to 60 minutes. Complex tasks (multi-page brochures, complex packaging, comprehensive brand identity manuals) follow an agreed milestone schedule communicated during order intake.
• Prompt Feedback: Turnaround times are contingent upon timely review and feedback from the client. Delays in client feedback automatically extend the completion schedule.

5 Revisions Policy & Scope Governance

We take pride in achieving complete client satisfaction with our visual outputs. Our revisions policy is designed to be fair, flexible, and constructive:

• Included Revisions: Clients receive fair and unlimited revisions within the original scope of the design brief. This includes adjustments to typography, font pairing, color tones, image repositioning, element resizing, and minor copy adjustments.
• Out-of-Scope Alterations: Revisions do not include completely new design concepts that deviate entirely from the initial brief, altering the core dimensions (e.g. converting a square Instagram post into a tri-fold brochure), or requesting entirely unrelated creative directions after a draft has been delivered. Such requests will be quoted as supplementary design tasks.
• Final Approval: Once a client confirms approval of a draft and requests final unwatermarked print/web-ready or source files, the design order is deemed successfully completed. Minor post-delivery tweaks requested within 48 hours will be accommodated at our discretion.

6 Pricing, Invoicing, Taxes & Payment Terms

All prices listed on Design Quixo or quoted by our official desk are in Indian Rupees (INR) unless explicitly stated otherwise.

• Payment Schedule: Standard single-asset tasks may require 100% advance payment or payment upon watermarked draft approval, as specified at the time of intake. Milestone billing applies for ongoing retainers or enterprise contracts.
• Payment Gateways: Payments are processed securely via authorized Indian payment aggregators and banking gateways supporting UPI (Google Pay, PhonePe, Paytm), Net Banking, NEFT/IMPS, and Debit/Credit Cards.
• Taxation: Applicable Goods and Services Tax (GST) is levied in accordance with prevailing Indian tax regulations. Tax invoices are issued upon request with the client's valid GSTIN.

7 Cancellation & Refund Policy

• Pre-Production Cancellation: If a client cancels an order before any designer has claimed the brief or commenced creative production, a 100% full refund will be processed within 5 to 7 business days to the original payment source.
• In-Progress & Delivered Drafts: Once a custom draft has been created and presented to the client, fee payments are non-refundable. In lieu of monetary refunds, Design Quixo offers revisions until the client's creative brief objectives are met.
• Platform Default: In the rare event that Design Quixo is unable to assign or deliver an acceptable draft within agreed contractual timelines, the client is entitled to a full refund.

8 Intellectual Property Rights, Ownership & Portfolio Showcase

Client Ownership Upon Full Payment: Subject to full payment of all agreed service fees, Design Quixo assigns to the Client all worldwide intellectual property rights, copyright, title, and commercial exploitation rights in and to the final approved graphic deliverables.

Client-Provided Assets & Warranties: The Client expressly warrants that all brand logos, trademarks, photographs, illustrations, slogans, and textual content supplied to Design Quixo are owned by the Client or legitimately licensed. The Client shall bear sole legal responsibility for any claims alleging copyright or trademark infringement arising from materials provided by the Client.

Portfolio & Marketing Rights: Unless the Client has executed a formal Non-Disclosure Agreement (NDA) with Design Quixo prior to project commencement, Design Quixo reserves the customary non-exclusive right to display the completed visual design in our public portfolio, social media showcases, and marketing case studies to exhibit our agency's design capabilities.

9 Client Indemnification Obligation

You agree to defend, indemnify, and hold harmless Design Quixo, its founders, directors, employees, contractors, and affiliates from and against any claims, liabilities, damages, losses, costs, or expenses (including reasonable legal fees) arising out of or related to:

• Any materials, logos, fonts, or assets provided by you that infringe upon third-party intellectual property, trademark, or copyright.
• Any unauthorized, unlawful, defamatory, or misleading promotional claims contained within the design briefs requested by you.
• Any off-platform transactions, payments, or communications conducted by you with third parties or individuals claiming affiliation with Design Quixo outside our verified official WhatsApp channel.

10 Prohibited Content & Right to Refuse Service

Design Quixo strictly refuses to create or assist in the creation of visual materials that:

• Promote hate speech, communal disharmony, violence, or illegal activities.
• Contain explicit pornography, nudity, or sexually suggestive adult content.
• Facilitate fraudulent schemes, financial scams, phishing, or counterfeit goods.
• Violate Indian cyber laws, national security, or sovereignty.

Design Quixo reserves the absolute right to terminate any project and cancel any order involving prohibited content without notice or liability.

11 Limitation of Liability & Warranty Disclaimers

To the maximum extent permitted under applicable law, Design Quixo provides its services on an "as is" and "as available" basis without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular business purpose, or non-infringement.

Liability Cap: In no event shall the total aggregate liability of Design Quixo, whether in contract, tort (including negligence), warranty, or otherwise, exceed the actual amount paid by the Client for the specific design order giving rise to the claim. Design Quixo shall not be liable for any indirect, incidental, punitive, or consequential damages, including loss of business profits, marketing expenditure, or brand reputation.

12 Governing Law & Exclusive Judicial Jurisdiction

These Terms & Conditions, the validity thereof, and the rights and obligations of the parties hereunder shall be governed by, construed, and enforced in accordance with the laws of the Republic of India.

Any disputes, controversies, or claims arising out of or in connection with these Terms, client orders, or service delivery shall be subject to the exclusive jurisdiction of the competent civil courts located in Indore, Madhya Pradesh, India. Parties agree to attempt good-faith mediation through official correspondence prior to initiating legal proceedings.
